Not surprising since women commit more acts of DV than men do. Giving them a free pass continuously is just going to lead to more brazen acts like this.

Hey, Luiz Simmons, John Edwards called….he wants his hair back!

The dialog is continuing on the shameful treatment of Amy Castillo during testimony with the Maryland House Judiciary Committee, in particular by batterer-lover Delegate Luiz Simmons.  Maybe it has been a while since Delegate Simmons has been laid, because he seems pretty preoccupied by it. He appears to relate sex to some kind of marital duties apparently, with him introducing a bill this session being haled by some as a bizarre “no sex = divorce” law.  We do know he loves to protect batterers:

Luiz Simmons’ Abuser Expungement Bill (Updated)

Delegate Luiz Simmons (D-17), who is a trial attorney, has introduced a bill enabling accused domestic abusers to expunge their court records. No, folks, we are not making this up.

Citizens of Maryland, do you really want a pig like this representing you?  Do you want to have your daughter and grandchildren murdered because she couldn’t get a protective order against an abusive husband?   Call your delegate now, today, and express your outrage at what happened in the House Judiciary Committee, and let them know you won’t stand for pigs on theJudiciary Committee, or in the legislature at all.  Call House Judiciary ChairJoseph F. Vallario, Jr., (410) 841-3488, (301) 858-3488, and tell him you won’t stand for people stinking up the committee.

This is from today’s Washington Post:

Md. General Assembly owes victims of domestic violence better protection

Thursday, March 4, 2010

MARYLAND once again has the chance to do what every other state in the country does in affording protections to victims of domestic abuse. A proposal that would relax the rigid standards for obtaining protective orders is being debated in the General Assembly. Unfortunately, its prospects are not good. We hope, though, that lawmakers wake up to the reality that their refusal to put in place common-sense safeguards endangers lives and makes Maryland a national disgrace.

The House and Senate are considering bills that would change the standard of proof needed to grant a final protective order. The bills, H.B. 700 by Del. C. Sue Hecht (D-Frederick) and S.B. 823 by Sen. Jennie M. Forehand (D-Montgomery), would replace the current standard of “clear and convincing evidence” to a “preponderance of the evidence.” Maryland is the only state that uses this higher standard when victims — and generally they are women — seek orders to protect themselves from their alleged abusers. In all other civil matters, Maryland courts require only a preponderance of evidence.

Contrary to the fears of some opponents, this would not open up the floodgates to capricious decisions based on false charges. Judges would still be able to judge the credibility of any claim, but they would have more discretion in reaching a decision. Instead of being bound by there being no doubt about a petitioner being in danger, the court would be able to use the more reasonable standard of there being a good chance of danger.

We can’t help but wonder what the outcome might have been had this standard been available to the judge who denied the request for a protective order from Amy Castillo. Ms. Castillo’s three children were drowned by a father whose threats about killing the children were deemed insufficient for a protective order. Ms. Castillo evoked her tragedy last month as she testified for easier access to protective orders before the House Judiciary Committee, a body notoriously hostile to this and other reforms sought by advocates for victims of domestic violence.

The committee has scuttled similar bills in previous years, and judging by the reception it gave Ms. Castillo, chances don’t seem much improved this year. What else to make of the argument that no problem exists because only (their emphasis) 14 percent of protective orders are denied because the standard of proof isn’t met? That’s not much of a consolation for Ms. Castillo or the others who make up that 14 percent. As Ms. Castillo told the committee: “When you’re in fear of your life and for your children, and you make that move to step out and do something about it, and then you go to get a protective order, and you don’t get it, it’s just really devastating. . . . It’s like a discouragement to make a change in your life that needs to be made.”

Safe Home, Safe Streets

Last week, members of SAFEHOME's staff and Board of Directors traveled to Topeka for the Kansas Coalition Against Sexual and Domestic Violence (KCSDV) 7th Annual Safe Home, Safe Streets Legislative Day. Victims service programs from across the state had a chance to meet with their local Representatives to educate them about domestic violence programs in their districts and the important legislation related to helping better serve victims. State grants provide essential funding for emergency shelter and other life-saving services for victims and their families. Sustaining this funding will ensure core services continue to be available.

During the Safe Home, Safe Streets Reception, SAFEHOME was honored with the KCSDV Program of the Year for our BridgeSPAN healthcare advocacy program. BridgeSPAN provides 24-hour on-site advocacy to victims of domestic violence who seek services in five Johnson County hospitals, as well as training for healthcare staff on domestic violence screening and resources. Since the program began in 2003, SAFEHOME has seen a 75% increase in the number of victims served by the program. Recent program accomplishments include the development of a "SAFE PLACE" sign to let people know that hospitals are a safe place to receive help if they are being hurt, a weekly Healthy Relationship group for inpatients at Shawnee Mission Medical Center, and creation of a hospital-wide "Domestic Violence and the Workplace" survey.

KCSDV also honored Vincent Dean and Dean Development, Inc. as the Community-Based Ally of the Year. As a SAFEHOME volunteer, Vincent Dean was instrumental in the rehabilitation of our state-of-the-art facility. For ten months, Vincent contributed 30-60 hours a week to the renovation project. In addition to donating his services as General Contractor, his family could often be found on weekends doing manual labor at the facility. During this time, his company Dean Development Inc. was completely behind Vincent's work. His staff handled hundreds of related phone calls, provided space for numerous meetings, and even held several donation drives for SAFEHOME. Congratulations to Vincent Dean & Dean Development Inc. We truly appreciate all your dedication to SAFEHOME.

It's About The Kids

Safety is something every child should be able to take for granted. However, an estimated 3 to 4 million children witness domestic violence annually. Children who witness family violence are often affected in ways similar to children who have been abused.

SAFEHOME helps children overcome negative effects of domestic violence through our Children's Program. The purpose of the Children's Program is to provide a safe and therapeutic environment where children and their mothers can heal from the violence they have experienced. The program includes art and play therapy, social activities to strengthen the parent/child relationship, and childcare with trained professionals. Services are available for both residential and non-residential clients.

Children are a large portion of the population we serve. Currently, 26 children are residing in SAFEHOME's shelter. If you can imagine having 10 children ages newborn to 3 years old living in your home, you can start to imagine the needs that we have. SAFEHOME needs baby monitors, potty chairs, pacifiers, and so much more. Check out today's Urgent Needs Wish List to learn about how you can help.

Colorado judge orders American mom to return child to father in France WTF?

Where's the pro-America crowd who backed Goldman on his case? Why is an American judge so eager to sell out an American mother? Maybe, it's because it's a mom? Mom claims she was coerced into the custody agreement and that Dad was physically and emotionally abusive. She also fears for the boy's safety.

Judge orders woman to return child to France

Father invoked a treaty on child abduction in seeking court order.

DENVER — A judge, acting in an international child abduction case, has ordered a Pueblo mother to return her 7 1/2-year-old son to his father in France.

The mother, Amanda Minarik, had refused to return the boy to Paris on Jan. 3, as scheduled at the end of a visit during Christmastime.

The father, Francois Salinier, invoked a treaty on child abduction to seek a court order compelling Minarik to return the boy. A 2006 child custody agreement specifies the boy is to live with his father in France.

Chief U.S. District Judge Wiley Daniel, in a 21-page decision on Monday, ordered Minarik to return the boy no later than Sunday.

In three days of court hearings last week, Minarik's attorney, Joseph Antolinez, assured the judge that she would comply, if that turned out to be Daniel's decision.    The treaty requires children who have been removed from their lawful custody to be returned unless there is good reason to the contrary.

The judge rejected Minarik's contention that her son would be subject to a grave risk of physical or psychological harm by being returned to Paris. Daniel also rejected her contention that her ex-husband coerced her into the custody agreement.

Minarik and Salinier lived in Pueblo and Colorado Springs after the their son was born in 2002, but they moved to France in mid-2004. She moved back to Pueblo in early 2006 and they were divorced in France.

The judge said he was unable to determine whether either Minarik or Salinier was telling the truth about her claims, which Salinier denied, that he physically and emotionally abused her.

In her testimony last week, Minarik conceded she thinks he is the boy's father. In a Jan. 3 e-mail to Salinier, she said he might not be the father.

Daniel stated the boy testified he would prefer to live in France with his half-sister, an 11-year-old daughter of Minarik, from an earlier relationship. The daughter lives in Pueblo with her mother. She is not part of the custody case.

DALE CITY, Va. — Police in suburban Washington, D.C., say a man and woman died in an apparent murder-suicide at a home used as a day care.

Prince William County police say seven children were there at the time but they did not see the shootings and were not in danger.

Killed were 39-year-old Tonitha M. White, who ran the day care, and 49-year old Richard A. Nichols, both of Dale City, Va.

Officers found the two upstairs in the home early Monday. Police say that when the shootings happened, White's 12-year-old daughter led the children to the basement and called police.

Father assaults mother while she is holding 2-month-old infant in her arms, and fractures baby's skull, putting him into critical condition; media headline and lead make it sound like the parents' mutual fight

March 2, 2010

Baltimore, Maryland --

"A 2-month-old boy was airlifted last night to Children's National Medical Center in Washington D.C. after suffering fractures to his skull during an argument between his parents, police said..."http://weblogs.baltimoresun.com/news/crime/blog/2010/03/2monthold_boy_suffers_fracture.html

2-month-old boy suffers fractured skull; father arrested

A 2-month-old boy was airlifted last night to Children’s National Medical Center in Washington D.C. after suffering fractures to his skull when the father started punching at he and his mother during an argument, police said.

The boy’s condition was not immediately known; police couldn't say and the hospital refused to disclose it. [UPDATE: Police say the boy is in critical condition.] Detective Kevin Hagan, a Baltimore police spokesman, confirmed that police were called at about 11:10 p.m. Monday to the boy’s home in the 2900 block of Spelman Rd., in Cherry Hill, for a domestic complaint.

The boy was in his mother’s arms, and both had been struck by his father, police said. The boy suffered a skull fracture and had subdural bleeding, and the mother had a cut lip.

Hagan said they were initially taken to Harbor Hospital, with the boy later transported to Children’s National Medical Center. Hagan said that the transport to DC was necessary because Johns Hopkins and University of Maryland Medical Center did not have available beds.

A law enforcement source said the father was arrested at the scene; Court records show 19-year-old Daryl Taylor was charged this morning with assault, reckless endangerment, second-degree child abuse, resisting arrest, and related charges.

An Ocean Beach man was convicted Tuesday of murdering his estranged wife to avoid paying child support. Jurors, in their fourth day of deliberations, found 69-year-old Henry Lisowski guilty of first-degree murder, and found true a special circumstance allegation of murder for financial gain in the death of 50-year-old Rosa Lisowski.

Her body has never been found. Henry Lisowski will be sentenced to life in prison without the possibility of parole on April 2. After Judge John Einhorn read the guilty verdicts, the defendant thanked and shook the hand of his attorney, Richard Gates.

Lisowski spoke when the judge asked him if he was willing to have his sentencing hearing on April 2.

“Your honor, I did not commit the crime … but you can sentence me to anything you wish now,” Lisowski told the judge. Outside court, one juror, identified as Martha, said the defendant’s story that his wife fell down some steps and hit her head didn’t add up.

“At the end, we were all very sure of our decision — completely sure,” the juror said. Veronica Ramos, who is married to Rosa Lisowski’s nephew and takes cares of the couple’s two young sons, cried as she spoke to reporters.

“For me, knowing Henry, Rosa, and the boys and their situation, it was obvious to me he was guilty,” Ramos said. “She knew it could happen. She told me it could, and when it happened, I knew it was Henry.”

The couple’s boys now live with Ramos and her family in Bakersfield. Rosa Lisowski had two other children from a previous relationship. Defense attorney Richard Gates maintained the evidence showed the victim hit her head when she fell down some steps at the defendant’s home and eventually died.

Deputy District Attorney Nicole Cooper told jurors that the defendant followed through on his threats to kill his wife if she didn’t drop her child support case. Cooper said the defendant had been threatening his estranged wife since November 2006. Lisowski had told the victim, “If you don’t drop the child support case, I’ll kill you. The children will be without a mother and I’ll be in jail,” according to Cooper.

The victim disappeared on March 24, 2008, after walking her 6-year-old son to school from her apartment in the Midway-Loma Portal District. The day she vanished, Lisowski was looking forward to the resolution of the child support case and anticipating a $30,000 disability settlement from a grocery store, Cooper said. When she didn’t return from dropping off her son, friends and family immediately suspected the defendant, Cooper said. In February 2008, Lisowski was ordered to pay the victim $1,029 a month and started to search the Internet for poison to kill his wife, Cooper said.

The story was corroborated by the couple’s son “Junior,” who said his father gave him some green powder and told him to put it in his mother’s water, the prosecutor said.

The child said he poured the powder into the carpet because he thought it was something bad, Cooper said. Gates urged the jury to disregard the “incredible” claim that a father would give his then-5-year-old son poison that the child could have ended up ingesting. He said “Junior” most likely picked up from friends and family the notion that his father killed his mother. Cooper said Lisowski had been facing a hearing on April 2, 2008, at which he was going to have to disprove contentions that he had underreported his assets by $1.3 million, followed by a child support hearing 27 days later.

After she went missing, police looked everywhere for the victim, eventually finding her blood on a kitchen counter in the defendant’s home and in the trunk of his vehicle, Cooper said, adding that her blood also was found on the inside of the passenger side door of Lisowski’s vehicle. The prosecutor said Lisowski went to Mexico after his wife disappeared, resurfacing in September 2008 with a letter sent to friends and family giving his version of his wife’s death.

In the letter, Lisowski said his wife was knocked unconscious by the fall and he revived her with water and put her in the car to go to the hospital. On the way there, the victim went into seizures and died, the defendant said. Cooper told the jury that the victim’s injuries were consistent not with a fall, but, rather, a violent attack with a hammer or having her head slammed into something.

3 dead in Darien -Late-night slaying of mom, dad, son 'was targeted thing'

Darien Police said they did not have a suspect in the early Tuesday killings of a towing company owner, his wife and their son -- even after interviewing more than 50 people.

Darien triple homicide

A surviving daughter, Angela Kramer, called 911 just before 3 a.m. from a closet in her parents' home after a gunman killed her father, Jeffrey R. Kramer, 50; her mother, Lori L. Kramer, 48, and a brother, Michael J. Kramer, 20, police said.

Angela Kramer, 25, and her ex-boyfriend share custody of their 13-month-old son and have been locked in a visitation battle in DuPage County Circuit Court, records show. Sources told the Chicago Sun-Times that the ex-boyfriend called police Tuesday morning saying he saw news coverage of the killings on TV and wanted to know whether Angela was OK.

The ex-boyfriend was accompanied to the Darien Police station by an attorney. Darien Deputy Police Chief John Cooper said the man was not a suspect.

The killings were the first in the western suburb since a murder-suicide in 1995, police said.

"It's terrible," said Aldo Costabile, 73, who lives a few doors from the murder scene. "I was never worried -- until now." But police insisted there was no reason for residents to worry about a killer on the loose, saying the shootings appeared to have been "targeted" and not random.

The three bodies were removed from the home and placed in a van at 4:45 p.m. by the DuPage County coroner's office as friends and relatives looked on. Three wreaths with red roses were left outside the house by mourners.

Jeffrey Kramer was the owner of a towing and auto repair shop in Cicero.

He and son Michael were found on the first floor, and Lori was found on a stairway to the second floor, police said. All three were shot multiple times and at least 12 bullet casings were discovered in the house -- all apparently from the same handgun, sources said. A window on the first floor was broken, the likely point of entry for the killer, police said.

No weapon was immediately found. The shooter likely fled through the snow, based on tracks near the house, and jumped into a car and drove off, police said.

During the slayings, Angela Kramer hid in an upstairs closet and called police just before 3 a.m., saying she had heard shots fired in the house in the 8900 block of Kilkenny Drive in the Tara Hill subdivision -- just north of Interstate 55 and east of Lemont Road, Police Chief Robert Pavelchik said.

Her brother Anthony Kramer, 29, who lives in the basement, was coming out a basement window as police arrived, Pavelchik said. Michael's 17-year-old girlfriend -- who was visiting and whom police would not identify -- ran from the house barefoot and knocked on neighbors' doors.

Pavelchik said he does not think the killings involved murder-suicide or that any of the survivors was involved, but he added, "It's clear to me that someone who knew the family was involved."

More than 50 people, including neighbors and relatives, were interviewed by police Tuesday. None of the survivors was able to identify the killer, Pavelchik said.

Deputy Chief Cooper added: "We are trying to figure out who we are looking for. It wasn't a random thing. It was a targeted thing."

Jeffrey Kramer owned Kramer's Auto Repair & Towing in Cicero, which he took over from his father, who started the business, employees said. They said Kramer was a diehard White Sox and Bears fan. They described him as "a good guy" who kept them employed despite the recession. "The guy gave me a chance," one employee said.

Fabian Sanchez owns Fabian's Auto Repair next door. He bought the property from Kramer's father. Of Jeffrey Kramer, Sanchez said: "I've known him almost 16 years. He was a nice man. We talked every day. He would say, 'Amigo, buenas tardes.' ''
